These terms govern your access to and use of Curvable (the "Service"), operated by Tiago Lemos (Trabalhador Independente), registered in Portugal under the trading name Nodewave ("Curvable", "we", "us"). By creating an account or paying for a subscription you agree to these terms. If you do not agree, do not use the Service.
1. The Service
Curvable generates branded motion-design launch videos from text prompts. We provide a web application, an associated rendering pipeline, and access to a library of motion components. The Service is provided as-is and we may add, remove, or modify features at any time.
2. Accounts
You must provide accurate signup information and keep it up to date. You are responsible for the activity on your account and for keeping your credentials secure. We reserve the right to suspend or terminate accounts that violate these terms, are inactive for an extended period, or pose a security risk.
You must be at least 16 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
3. Subscription and billing
The Service is offered on a paid subscription basis. Prices are shown on our pricing page and are exclusive of applicable taxes (VAT, sales tax, etc.), which are added at checkout.
- Subscriptions auto-renew at the end of each billing period until you cancel.
- You can cancel at any time from the customer portal. Cancellation takes effect at the end of the current paid period; you retain access until then.
- Each plan includes a monthly credit allowance, consumed by metered actions in the product. Unused credits do not roll over.
- If a payment fails we will retry automatically. Sustained payment failure may result in suspension of access.
- We may change pricing for future billing periods on 30 days notice. Changes do not affect the current paid period.
4. Refunds
All payments are final. We do not issue refunds for subscription fees— including (but not limited to) unused credits, partial-month usage, or change of mind. You may cancel at any time to prevent the next renewal.
Exceptions: where required by applicable law (for example, the EU 14-day right of withdrawal for consumers, where applicable), or in our discretion when a clear billing error has occurred. Mandatory consumer rights are not affected by this clause.
5. Acceptable use
You agree not to use the Service to:
- Generate content that is illegal, infringing, defamatory, discriminatory, or that incites violence or hatred.
- Generate content that impersonates a real person without their consent.
- Generate content that misrepresents the source of the content (for example, falsely attributing it to a third party).
- Use the Service for spam, phishing, fraud, or other malicious campaigns.
- Reverse engineer, scrape, or attempt to extract our source code, model prompts, or the templates of the Service.
- Resell or sublicense access to the Service or use it to build a competing product.
- Bypass usage limits, rate limits, or any technical access controls.
- Submit content that contains malware, infringing material, or sensitive personal data (such as government IDs or financial information).
We may suspend or terminate your account for violations and we may report serious violations to law enforcement.
6. Your content
You retain ownership of the prompts you submit and the brand materials you provide. By submitting them you grant us a worldwide, non-exclusive, royalty-free license to process them solely for the purpose of providing the Service to you.
You own the videos generated for your account, subject to the underlying license of any third-party templates or assets we include in your output. You are responsible for ensuring that your use of generated videos complies with applicable law, including rights of third parties referenced in your prompts or brand materials.
7. Our content
The Service, including its UI, code, templates, motion components, and documentation, is owned by Curvable and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service while your subscription is active. Nothing in these terms transfers ownership of the Service to you.
Some components are made available under an open-source license at github.com/Curvable/motion. Those components are governed by the license stated in that repository.
8. AI-generated output
The Service uses third-party large language models and rendering tools to produce video output. AI output can be inaccurate, contain unexpected elements, or fail to match your intent. You are responsible for reviewing generated output before using it publicly. We do not guarantee the accuracy, suitability, or legality of generated content for your specific use case.
9. Service availability
We aim for high availability but do not guarantee uninterrupted or error-free operation. We may perform maintenance, deploy updates, or experience downtime caused by third-party infrastructure. We are not liable for losses resulting from temporary unavailability.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.
11. Limitation of liability
To the maximum extent permitted by applicable law, in no event will Curvable be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from or related to your use of the Service.
Our total aggregate liability for any claim arising from these terms or the Service is limited to the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred euros (€100), whichever is greater.
Mandatory consumer rights under applicable law are not affected by these limitations.
12. Indemnification
You agree to indemnify and hold Curvable harmless from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these terms, your misuse of the Service, or your infringement of any third-party right.
13. Termination
You can stop using the Service at any time by cancelling your subscription and deleting your account. We may terminate or suspend your account at any time for material breach of these terms, for extended inactivity, or where required by law. On termination, your right to use the Service ends. Sections that by their nature should survive (ownership, disclaimers, limitation of liability, indemnification, governing law) will continue to apply.
14. Changes to these terms
We may update these terms. The "last updated" date at the top reflects the most recent version. Material changes will be announced via email or in-product notice. Continued use of the Service after a change means you accept the revised terms.
15. Governing law and disputes
These terms are governed by the laws of Portugal. Disputes arising from these terms or the Service will be brought before the competent courts of Aveiro, Portugal, except where mandatory consumer protection law provides for the courts of your country of residence.
